Propane Pricing Agreement Contract for: Powers Oil and Propane Tank

Thank you for choosing Powers Oil Company, Ltd. dba Powers Oil and Propane (“Powers Oil and Propane” or “we”) as your propane provider! To provide you with “The Service You Want, The Value You Need”, we are offering our customers (“customer” or “you”) an opportunity to contract your propane price pursuant to this Propane Pricing Agreement (“Agreement”). These programs are OPTIONAL but will become binding on the Customer once this Agreement is signed. If you choose to be in either program, you MUST complete and submit the fillable form by September 10, 2026.

LOCK-IN PROGRAM

With this program, the customer will pay a $75.00 fee to Lock-In a propane price of $2.399 per gallon for the requested number of gallons (minimum 400 gallons) you estimate that you would like for the period of October 1, 2026 – March 31, 2027. You do not pay for the gallons until they are delivered.

A fee of $75 will be charged if the customer did not use at least 80% of their contracted gallons.
The customer can purchase additional gallons at the market price unless circumstances allow us to offer you more gallons at the same rate.

PRE-BUY PROGRAM

With this program, the customer will pay up front for the requested number of gallons (minimum 400 gallons) for the period of October 1, 2026 – March 31, 2027, at a price of $2.299 per gallon. There is no fee to participate in the Pre-Buy program.

A fee of $75 will be charged if the customer did not use at least 80% of their contracted gallons.
The customer will receive credit on account of the dollar value of the unused gallons. The gallons do not carry over, but the money does.
The customer can purchase additional gallons at the market price unless circumstances allow us to offer you more gallons at the same rate.

Terms & Conditions

The term of this Agreement ("Term") will begin on October 1, 2026, and will end on March 31, 2027. Every delivery made by Powers Oil and Propane during the Term will apply toward this Agreement until the contracted gallons as specified in this Agreement are depleted. Customer understands and agrees that Customer may not add additional gallons to this Agreement once this Agreement has been accepted by Powers Oil and Propane. Gallons contracted under this Agreement cannot roll-over beyond the Agreement Term. Customers who pre-bought gallons will be issued an account credit (if applicable) in the event of any undelivered contracted propane gallons at the end of the Term once the Customer's duties and obligations herein have been performed accordingly. All additional propane purchases made by the Customer thereafter will be delivered at then current market prices.

Lock-In fees are due upon signing this Agreement. Pre-Buy payment must be made in full within 30 days of receipt of invoice. Should a customer's payment become delinquent, this Agreement will be null and void and additional propane purchases will be delivered at then current market prices. Propane must be delivered to and dispensed from tanks (i) owned by Powers Oil and Propane and leased to Customer, or (ii) otherwise owned by the Customer. All fees are non-refundable.

The undersigned Customer has fully read and agrees to the terms and conditions contained in this Agreement, as well as Powers Oil and Propane's standard terms and conditions located at PowersOilandPropane.com/terms and conditions, which are incorporated herein by reference.
